These Terms and Conditions ("Terms") govern your use of the bradmcallister.com website and the web design services provided by Brad McAllister ("we," "us," or "our"). By accessing our website or engaging our services, you agree to be bound by these Terms.
1. Services
We provide freelance web design and development services including but not limited to:
- Custom website design and development
- E-commerce solutions
- WordPress development and maintenance
- UI/UX design services
- Website optimization and SEO
- Ongoing website support and maintenance
2. Project Agreement
All projects begin with a detailed proposal outlining:
- Project scope, deliverables, and timeline
- Total project cost and payment schedule
- Client responsibilities and requirements
- Revision process and limitations
Work commences only after written agreement and initial payment receipt.
3. Payment Terms
Payment Schedule
- 50% deposit required before project commencement
- Remaining 50% due upon project completion
- Monthly retainer for ongoing maintenance services
Payment Methods
We accept bank transfers, PayPal, and Stripe payments. All invoices are due within 14 days of issue unless otherwise agreed in writing.
Late Payments
Late payments may incur a 2% monthly charge. Work may be suspended for overdue accounts exceeding 30 days.
4. Client Responsibilities
Clients are responsible for:
- Providing accurate project requirements and content
- Timely feedback and approval at project milestones
- Supplying necessary assets (images, text, branding materials)
- Domain name and hosting arrangements (if required)
- Testing and approval of deliverables
5. Revisions and Changes
Each project includes a specified number of revision rounds as outlined in the project proposal. Additional revisions or scope changes may incur extra charges at our standard hourly rate.
Major scope changes require a new project agreement and may affect timeline and pricing.
6. Intellectual Property
Client Ownership
Upon full payment, clients own the final website design and custom code created specifically for their project.
Third-Party Components
Third-party themes, plugins, and frameworks remain under their respective licenses. We retain rights to general methodologies, techniques, and reusable code components.
Portfolio Rights
We reserve the right to showcase completed work in our portfolio and marketing materials unless confidentiality is specifically agreed upon.
7. Warranties and Disclaimers
Limited Warranty
We warrant that delivered work will be free from defects for 30 days post-delivery. This warranty covers functionality issues, not design preferences or minor browser variations.
Disclaimer
We cannot guarantee specific search engine rankings, traffic levels, or conversion rates. Website performance depends on many factors beyond our control including hosting, content, and market conditions.
8. Limitation of Liability
Our total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific project. We are not liable for indirect, consequential, or punitive damages.
9. Termination
Either party may terminate the agreement with 14 days written notice. Upon termination:
- Client pays for all work completed to date
- We deliver all completed work and source files
- Both parties return any confidential materials
10. Force Majeure
Neither party shall be liable for delays or failures due to circumstances beyond reasonable control, including but not limited to natural disasters, government actions, or technical failures of third-party services.
11. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be resolved through the courts of England and Wales or through mutually agreed alternative dispute resolution.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on our website and take effect immediately. Continued use of our services constitutes acceptance of modified Terms.
